It praises the treatment. Names the result. Thanks you for changing their life.

On your website, that review is a breach.

Here is the rule most clinics miss. Section 133 of the National Law bans testimonials in advertising a regulated health service. Not the vague ones. All of them.

A testimonial is any review that talks about the clinical side. Symptoms. Diagnosis. Treatment. The outcome. “Dr Lee sorted my back pain in two sessions” is a testimonial. It cannot go in your advertising. AHPRA has taken action for exactly this.

So what can you use? The service experience. “Reception was easy and the rooms were clean” is fine. It says nothing about care or results. The line is simple. Clinical is banned. Front-desk is fine.

Now the part that catches everyone. Google reviews.

You cannot control what a patient posts on Google. AHPRA knows that. A review you did not ask for, sitting on a platform you do not run, is not your breach. You can leave it there.

Then someone on your team gets clever. They embed the Google widget on the homepage. They screenshot the five-star and post it to Instagram. They add a “what our patients say” section.

The moment you feature that review, you own it. It stops being the patient’s words on Google. It becomes your advertising. And now it is your breach.

Same trap with asking. Asking a patient how the booking went is fine. Asking them to review their treatment is asking them to write you a breach.

TGA rules stack on top. If the review points to a prescription medicine or the result it gave, you have a second problem in the same sentence.

Here is the reframe. You are not allowed to let patients sell for you. Good. It forces you to prove yourself with facts instead.

Years in practice. Number of patients seen. What actually happens in a consult. Your qualifications, sitting right next to the claim they support. None of that needs a testimonial. All of it builds more trust than a stranger’s five stars.

So thank your happiest patient. Mean it.

Then keep their review off your website.

1. Your registration and scope. What you are registered to do, and with whom. AHPRA, a board, a financial licence. This shapes what can be claimed. A writer who knows your scope will not promise something you cannot offer.

2. What you cannot name. Prescription products are the classic. Hand over a short list of what must be talked around. Saves a painful rewrite.

3. Your close calls. If a regulator, competitor, or platform has ever pulled you up, share it. It is not embarrassing. It is the most useful thing in the brief. It shows the writer exactly where your risk lives.

4. Your real proof, minus the testimonials. You cannot lean on patient or outcome quotes. So give what you can use. Years in practice. Case numbers. Credentials. Process. The raw material for compliant trust.

5. Who signs off, and how fast. Compliant copy needs a second set of eyes. A clinical lead, a compliance officer, a licence holder. Name them and the timeline. Stops surprises at the end.

Here is the tell that you have hired the right person. A good regulated-industry writer asks all of this even when you forget. If a writer takes your brief without a single question about scope, risk, or sign-off, walk away. It means pretty copy a regulator could shred.

The best outcome is simple. You hand over the facts and the limits. The writer turns them into copy that sounds human, reads clean, and stays inside the rules. The hype is gone before it starts. The end-of-project legal scramble never happens.

Compliance is not the enemy of good copy. It is the brief. The limits force clarity, and clarity is what convinces people anyway.

Here’s a move I see on almost every flagged page. A risky claim up top, and a tiny disclaimer at the bottom hoping to cancel it out.

It doesn’t work. A disclaimer can’t undo a non-compliant claim. It just sits there, in small grey text, while the claim does the damage.

Clinics love the disclaimer because it feels like a seatbelt. “Results may vary.” “Speak to your doctor.” “This is general information only.” Bolt one on and you feel covered.

You’re not. Three examples of what a disclaimer can’t fix.

You named the drug. A “speak to your doctor” line under the brand name doesn’t help. If a Schedule 4 substance is on the page, naming it is the breach. The footnote doesn’t remove it.

You promised a result. “Look ten years younger” with a “results may vary” tag is still a promise you can’t keep. The disclaimer admits the claim is shaky. It doesn’t make it legal.

You used a treatment testimonial. A glowing patient quote with “individual results vary” beneath it is still a banned testimonial. You’ve just labelled it.

See the pattern? The disclaimer points straight at the problem. It’s a confession, not a fix.

Here’s what actually protects you. Don’t make the claim in the first place. Write the page so there’s nothing to disclaim.

That doesn’t mean a bare, lifeless page. It means:

• Describe the treatment instead of promising the outcome.

• Sell the consultation instead of the substance.

• Show your credentials instead of your patients’ results.

Do that, and the disclaimer becomes what it should be. A small, honest note at the bottom. Not a load-bearing wall holding up a page that should never have gone live.

Stop writing claims you need a disclaimer to survive. Write copy that doesn’t need rescuing.

If your copy keeps getting pulled, rewritten, or pinged by compliance, it’s not bad luck. It’s a pattern. And once you see it, you can’t unsee it.

Flagged copy almost always breaks in the same few places. Here they are, in the order I find them.

1. The hero promises an outcome. “Look younger.” “Feel like yourself again.” “Get your life back.” Warm, human, and a claim you can’t prove for everyone. The top of your page is the first thing a regulator reads. Make it describe, not promise.

2. There’s a testimonial about the treatment. The thing you’re proudest of is usually the thing that gets you flagged. Reviews about a clinical result are out. Move client praise to your service and your process.

3. A prescription product is named. Brand or category. If a Schedule 4 substance is on the page, it doesn’t matter how careful the rest is. Talk about the consultation instead.

4. “Safe,” “painless,” “permanent,” “guaranteed.” The comfort words. Each one is a claim. Each one has to be true for every patient. None of them are. Circle them and cut them.

5. The risk is missing. Compliant copy doesn’t hide what could go wrong. It points people to a practitioner who explains it. A page that’s all upside reads as an ad, and ads for health services get scrutinised hard.

Notice the theme? Every flag is a shortcut. A promise you can’t keep, a quote doing the selling, a risk swept under the rug. The rules aren’t picking on you. They’re catching the easy moves.

Here’s the fix, and it’s boring on purpose. Read your page top to bottom and ask one question at every line: can I prove this, with the risks shown? Cut or rewrite anything that fails.

Do that once and your flag rate drops to near zero. Not because you got lucky. Because you stopped handing them things to flag.

Every clinic owner believes the same thing. Follow the rules and your marketing turns into a wall of grey legal mush.

It’s a lie. And it’s costing you bookings.

Here’s where the belief comes from. You picture compliance as a list of things you can’t say. No promises. No testimonials. No “safe.” No before-and-afters. Strip all that out and what’s left feels like a terms-and-conditions page.

But that’s not what compliant copy is. That’s just bad copy that happens to be legal.

The rules don’t ban good writing. They ban shortcuts. Hype, fake guarantees, borrowed glory from a happy patient. Those are lazy ways to sell. Take them away and you’re forced to do the harder, better thing. Be clear and useful.

Think about what actually convinces a nervous patient.

• Not a “100% safe” badge. A plain explanation of what the treatment involves.

• Not a five-star quote. Your credentials and your years in the room.

• Not “guaranteed results.” An honest “here’s what to expect, and here’s what varies.”

Every one of those is fully compliant. And every one converts better than the hype it replaces, because people can smell hype, and it makes them trust you less.

I’ve rewritten dozens of flagged pages. The pattern is always the same. We cut the risky lines. The page gets shorter, clearer, more human. Bookings go up, not down.

Compliant copy isn’t the careful, boring version of good marketing. It is good marketing. The rules just drag you toward clarity faster than your competitors will get there.

Most clinics treat their website like a legal document and their Instagram like a free-for-all. Careful site. Wild socials.

Same business. Same rules.

AHPRA and the TGA don’t stop at your homepage. A caption is advertising. A Story is advertising. A boosted post is very obviously advertising. Every rule that governs your website governs your grid. Here’s what clinics break without noticing.

You name a prescription product. The brand you can’t put on your site, you can’t put in a caption. A famous injectable. A weight drug everyone’s googling. Naming a Schedule 4 substance to the public breaches the rules on Instagram exactly as on your homepage.

You leave a glowing review in the comments. A patient writes “best results of my life, Dr X is a miracle.” You didn’t write it. But you’re responsible for your comments. Leaving a treatment review up can count as a testimonial you’re using. The comment box isn’t a loophole.

You repost a happy patient’s Story. Feels generous. It’s also a treatment testimonial, shared by your account. Off limits, even when it’s real.

You run an influencer collab. If you pay or gift someone to promote a treatment, their post is your ad. The rules follow the money.

You post a before-and-after reel. Same minefield as the website, faster to spread, harder to pull back.

The one habit that fixes most of this: moderate your comments. Hide treatment reviews as they land. It’s not rude, it’s compliance. You can even pin a friendly note: “We remove reviews that mention treatments, to stay within Australia’s health advertising rules.” That line builds trust instead of breaking one.

What you can post all day, zero risk: education. How a treatment works. What to expect at a consult. Your team, your training, your process.

That content is fully compliant, and it’s exactly what grows a following. People follow clinics that teach them something. They scroll past clinics that only sell.

A happy client says something glowing about their results. You screenshot it, put it on the homepage, feel great. In a regulated industry, that single share can be the breach.

Here’s how the trap works across three fields I write for.

Healthcare. AHPRA bans patient reviews about a clinical service. A quote praising your treatment, surgery, or therapy can’t go in your advertising. Real, unpaid, lovely. Still off limits. The logic: one person’s result isn’t a fair guide for the next. So the testimonials you most want are exactly the ones you can’t use.

The clean workaround: reviews about the non-clinical stuff. Your booking, your staff, your wait times. Fair game.

Finance. ASIC watches for anything painting an unrealistic picture. “I doubled my money in a year” is a minefield. It implies a result others won’t get. It can read as advice. It can skip the risk warnings the law expects.

Keep praise on your service, not the outcome. “They explained everything clearly” is fine. “They made me rich” is not.

Cosmetic and wellness. The moment a treatment is involved, health rules apply. A before-and-after with a happy caption slides into banned-testimonial territory without anyone meaning it.

The common thread: a testimonial becomes a claim. And a claim has to be true, balanced, and fair for the next person who reads it. One person’s outcome rarely clears that bar.

Here’s the filter. Treat every quote as if a regulator will read it next to your worst possible result. Still fair? Still honest about risk? If not, it doesn’t belong in your ads, however kind it is.

The relief in all this: trust never came from testimonials anyway. It comes from clarity. Your process, your credentials, your honesty about what to expect. All fully compliant, all working harder than a five-star quote.

Before you paste that review on your site, ask one thing. Is it praising your service, or promising a result? The first is usually fine. The second can cost you.

A weight clinic sent me a new landing page. The headline named the drug. The famous one. The one in the news every week.

I told them to take it off.

Here’s the rule that catches more clinics than any other right now. In Australia, weight-loss injectables are prescription-only. Schedule 4. You cannot advertise a prescription medicine to the public by name. Not in an ad. Not on a landing page. Not in a caption. The TGA has issued warnings about this exact category.

“But everyone knows the name already.”

That’s the pushback every time. The drug is everywhere. Patients walk in asking for it.

Doesn’t matter. The rule isn’t about whether people know the name. It’s about a business promoting a prescription substance to the public. Public awareness doesn’t buy you permission.

So what can you say? Plenty.

• Describe a doctor-led medical weight-management program.

• Say a doctor assesses whether prescription treatment is appropriate.

• Talk about the consult, the monitoring, the follow-up care.

You just can’t name or promote the specific drug.

Here’s the swap I made on that page.

Before: named the drug, promised the weight loss.

After: “Doctor-led medical weight management, with a plan built around your health.”

Same service. Clearer offer. No breach.

And the trap that gets people: you can’t fix it with a disclaimer. A “speak to your doctor” line underneath doesn’t undo the ad. If the brand name is on the page, the brand name is the problem.

Weight medicine is the hottest thing in health marketing this year. Demand is enormous. So is the scrutiny. The TGA is watching, and competitors report each other constantly. One screenshot of your homepage starts a complaint.

The clinics winning this category aren’t shouting the drug name. They’re marketing the care around it. The doctor. The assessment. The plan. That’s fully allowed, and honestly it sells better. It sounds like medicine instead of a vending machine.

Name the care. Not the drug.

Your cosmetic ads live under AHPRA and TGA rules whether you’ve read them or not. Break them and you’re looking at a fine, a public complaint, or a forced rewrite.

Good news. The rules aren’t hard. Nobody just explains them in plain English. So here.

Can’t: call a treatment “safe.”
Every procedure has risk. “Safe” hides it. Describe the treatment and say a practitioner assesses you. Don’t wave the risk away.

Can’t: promise a result.
No “guaranteed,” no “permanent,” no “ten years younger.” Bodies differ. A promise you can’t keep for everyone is a claim you can’t make.

Can’t: use patient testimonials about the treatment.
Reviews about a clinical service are off limits. That glowing quote about someone’s results? Can’t use it. Reviews about your parking and your front desk? Fine.

Can’t: name a prescription product, or its category.
Not the brand. And since the TGA’s 2025 clarification, not the category either. Terms like “anti-wrinkle injections” and “dermal fillers” point straight to prescription-only substances, so they’re out too. Talk about the consultation instead.

Can’t: rush or scare people.
No “last chance” pricing on a medical procedure. No countdown timers. Health isn’t a flash sale.

Now the part clinics forget. Here’s what you absolutely can do.

Can: educate. Explain how something works, what it involves, what recovery looks like.

Can: show your credentials. Training, registration, years in practice. Facts about you sell hard in this space.

Can: set expectations. “Results vary. A consult comes first.” Honest, and it protects you.

Can: invite a conversation. “Book a consultation to discuss your options” is the cleanest CTA in cosmetic marketing.

The test for any line: could I prove this, with the risks shown, to a regulator? No? Rewrite it.

Most clinics think the rules make copy boring. They do the opposite. When you can’t hype, you have to be clear and useful. Clear and useful is what books consults.

Inform, don’t promise. Describe, don’t hype. Show your credentials, not your patients’ faces.
